Terms of Use
Article 1 Definitions
These Terms and Conditions apply to customers and the Japan Philharmonic Orchestra (hereinafter referred to as "our organization") who use the various ticket and product sales services and membership registration services provided by our organization (hereinafter referred to as "our organization"). By using our services, you are deemed to have agreed to these Terms and Conditions.
"Customer" refers to any customer who uses this site.
"Member" means a person who has applied for membership and whose use is approved by the Association.
If a minor wishes to use this service, they must obtain prior consent from their legal guardian each time.
Article 2 Scope of Application and Changes to These Terms
In addition to the main text of these Terms and Conditions, the individual provisions set out on each page also constitute part of these Terms and Conditions. In addition, if there is a difference between these Terms and Conditions and the individual provisions, the provisions of the individual provisions shall take precedence.
We may change all or part of these terms and conditions and individual terms and conditions without prior notice to you, so please be sure to check these terms and conditions and individual terms and conditions when applying for ticket reservations. After any changes are made, only the changed terms and conditions will be valid.
If we determine that changes to the system or content of this Service are necessary for operational or technical reasons, we may make changes to the system or content of this Service without prior notice to you.
Article 3 Suspension or Cancellation of the Service
Our company may suspend or discontinue all or part of the operation of this service if any of the following applies.
(1) When performing scheduled or emergency maintenance or inspection of the system of this service. (2) When there is an abnormality, breakdown, or failure in the equipment installed or managed by our company, or other reason that makes it impossible to provide the Service to you. (3) When the provision of the Service is impossible due to war, riots, disturbances, labor disputes, earthquakes, volcanic eruptions, floods, tsunamis, fires, power outages, disruptions to transportation, or other causes beyond the reasonable control of the Company. (4) Any other case where the Company deems it necessary for the operation of the Service.
Regardless of the reason, we shall not be liable for any damages suffered by customers due to the interruption or discontinuation of the provision of this service.
Article 4 Prohibited matters
When using this service, you must not engage in the following acts:
(1) Any act that infringes or may infringe the copyright, property rights, reputation, privacy, know-how, or other rights of other users of the Service, third parties, or our organization. (2) In addition to the above, any act that causes or may cause disadvantage or damage to other users, third parties, or the Association. (3) Any act that is contrary to public order and morals, or any act that may be contrary to public order and morals, or any act that provides information that is contrary to public order and morals to other users of the Service or third parties. (4) Criminal acts, acts that are linked to criminal acts, or acts that may lead to criminal acts (5) Activities related to politics, religion, or sexual customs (6) Any business activity using the Service, any profit-making activity, or any activity intended to prepare for such activity. (7) Using or providing harmful programs such as computer viruses through or in connection with the Service. (8) Any unauthorized use of login ID, password, or PIN number (9) Any act that violates or may violate these Terms or laws and regulations. (10) Any other conduct that the Company deems inappropriate
Article 5 Disclaimer
Use of this service is entirely at the customer's own risk, and the Company makes no guarantees whatsoever regarding the completeness, accuracy, reliability, or usefulness of the content of this service or the information that customers obtain through this service.
(1) We shall not be liable for any damages suffered by you or any third party arising from the suspension, interruption, change or abolition of the Service, delay in the provision of the Service, or any other damages incurred in connection with the Service. (2) We will do our best to operate the Service based on the current state of the art, but we cannot guarantee that information will be protected from leakage, loss, or tampering by third parties. (3) We do not guarantee that the number of tickets sold through this service will meet the purchase wishes of all customers, nor do we guarantee that the information written on tickets sold through this service is true (including that the event will be held as described). (4) In relation to this service, the Company shall not be liable for any problems such as non-delivery, delayed delivery, or misdelivery of e-mails. (5) In relation to this service, the Company shall not be liable for any problems that arise during the payment of ticket prices or delivery of tickets.
Article 6 Use of copyrighted works, etc.
You may not use any copyrighted material, trademarks, etc. provided through our services in any way beyond the scope of your personal use as defined by the Copyright Act, Trademark Act, etc. without the permission of the rights holder.
Unless otherwise specified, copyright, trademark rights, portrait rights and other intellectual property rights in each section of this website belong to our organization, and you must respect the rights of the rights holders.
If a dispute arises between you and a rights holder, you shall resolve it at your own responsibility, and our organization shall not be held responsible even if you are liable for compensation or are subject to criminal sanctions, etc.
Article 7 Handling of Personal Information
We will handle your personal information in accordance with our separately established "Privacy Policy," and you agree to these terms of use.
Article 8 Governing Law
The establishment, validity, performance and interpretation of these Terms and Conditions shall be governed by Japanese law.
Article 9 Jurisdictional Court
If a dispute arises between you and our company in relation to the service, both parties will negotiate in good faith to resolve the dispute.
If the dispute cannot be resolved through consultation, the Tokyo District Court shall be the court of exclusive jurisdiction.
Article 10 Supplementary Provisions
These terms and conditions will come into effect on May 14, 2010 (midnight). Partially revised on November 1, 2022, and implemented on the same day.
Individual regulations Ticket sales
Article 1 Refusal to sell
We will refuse to sell tickets in the following cases:
- If a member makes a false declaration regarding matters specified by the Association or fails to make a required declaration.
- If you engage in any behavior that causes inconvenience to other members or third parties or that interferes with our smooth sales.
- If you do not complete the required procedures within the deadline provided by our organization.
- If you do not follow the purchasing method specified by our organization.
- If a member chooses to pay by bank transfer and is approved, but fails to make the transfer by the due date.
Article 2: Determination of sales method
If necessary, restrictions may be placed on the number of tickets purchased, the method of purchase, etc.
Article 3 End of Sales
Even during the sales period, sales will end for each performance once our planned number of tickets has been sold. However, sales may resume if the event organizer announces additional seats or additional performances.
Even before or during the sales period, sales may be suddenly terminated due to circumstances on the part of our organization or the event promoter. In such cases, our organization shall not be held responsible in any way.
Article 4 Lottery Sales
We will inform customers who have applied for the "Lottery Sale" of the results of their selection via the reservation confirmation screen and email. Furthermore, we will not respond to any inquiries regarding the results of the "Lottery Sale" application or the status of the "Lottery Sale" application.
Article 5: Applications for the same content
The organization will not be held responsible for any duplicate applications made through this service due to input errors by the customer or problems with the communication environment, etc. Furthermore, we will not provide refunds for any such applications.
In this service, if a particular customer makes multiple applications for the same content and the Company determines that the customer has no intention of purchasing, the Company may not proceed with any subsequent purchase procedures for any of the applications.
Article 6: Sending an email confirming application details
You may not use any copyrighted material, trademarks, etc. provided through our services in any way beyond the scope of your personal use as defined by the Copyright Act, Trademark Act, etc. without the permission of the rights holder.
Unless otherwise specified, copyright, trademark rights, portrait rights and other intellectual property rights in each section of this website belong to our organization, and you must respect the rights of the rights holders.
If a dispute arises between you and a rights holder, you shall resolve it at your own responsibility, and our organization shall not be held responsible even if you are liable for compensation or are subject to criminal sanctions, etc.
Article 7: Prohibition of changes or cancellations to reservation details
Once a ticket reservation has been made, no changes or cancellations to the reservation will be accepted.
Article 8 Ticket prices and payment methods
After your reservation application is confirmed, we will process the payment for the ticket price, consumption tax, delivery fee, etc. (hereinafter referred to as "Price, etc.") according to the details of your application.
The customer shall pay the fees, etc. by the due date set by the Company using one of the methods listed in the "Individual Provisions."
Article 9: Ticket Delivery
The tickets you have applied for will be shipped to the address you have specified after payment has been confirmed in accordance with the previous article.
We will not be held responsible for any failure to deliver tickets etc. to you due to an incorrect delivery address provided by you.
We only ship tickets within Japan. Please note that we are unable to ship tickets outside of Japan.
Article 10: Prohibition of resale
It is prohibited to resell products purchased through this service for profit, entrust the resale to a third party, list them on resale sites, auctions, or internet auctions, or to transfer them for a fee without the consent of the organizer.
If you violate the preceding paragraph, the promoter may, at their discretion, invalidate your purchased ticket, not refund the ticket price, and deny you entry. If you have already entered the venue, you may be asked to leave. Furthermore, we are not responsible for any problems arising from tickets purchased from sources other than direct purchases from "ticket shops," "resale sites," "purchase agents," "scalpers," etc.
Article 11 Cancellation of performance and refund
Our organization will not be held liable for any damages incurred by customers or third parties due to the cancellation or postponement of an event or other changes to the content. Furthermore, if a ticket price is refunded due to a canceled or changed event, the refund will be made only within the refund period set by the promoter and our organization, and will not be made after the refund period has passed. Furthermore, only the ticket price will be refunded, and fees other than the ticket price, such as shipping fees, system usage fees, ticket issuing fees, and cancellation fees for accommodation or travel expenses, will not be refunded.
Article 12 Loss and Theft
Tickets will not be reissued under any circumstances (lost, stolen, damaged, etc.).
Article 13 Payment by credit card
For customers who choose to pay by credit card, we will carry out the credit card authorization procedure. The sales contract will be concluded once the credit card authorization procedure has been completed. Please note that if payment cannot be made with your credit card for any reason, such as false input, incorrect input or omission when applying for ticket reservations, or failure to comply with the terms and conditions of each credit card company, we will be unable to sell you tickets.
Article 14 Payment at convenience stores
If you choose to pay at a convenience store, you will be provided with a payment slip on the ticket reservation completion screen and in the reservation completion email. You must pay the fee at the convenience store by the due date specified by our organization. The ticket sales contract will be concluded upon completion of payment. If payment is not confirmed by the due date specified by our organization, we will not be able to sell you the tickets.
Article 15 Payment by bank transfer or postal transfer
Customers who choose to pay by bank transfer or postal transfer must transfer the payment to the account specified by our organization by the payment due date specified by our organization. The cost of the transfer will be borne by the customer. The ticket sales contract will be concluded upon completion of the transfer. If payment is not confirmed by the due date specified by our organization, or if the transferred amount is insufficient to cover the payment, we will not be able to sell the tickets.
Article 16 Supplementary Provisions
These terms and conditions will come into effect on May 14, 2010 (midnight). Partially revised on November 1, 2022, and implemented on the same day.
